Employer’s Agent and Contract Administration

An Employer’s Agent represents a Client during a construction project. The Agent sits between its Client and the Contractor, representing their Client’s interests throughout a building contract, usually covering the design and build phases of a development.

When projects are being constructed via a design and build route, BWA’s Employer’s Agents work towards budget, time, quality and safety objectives to meet the clients’ needs. BWA’s collaborative approach uses established tools for clear communication and reporting which enables us to manage the project from start to finish effectively. Key responsibilities undertaken by an Employer’s Agent include:

Developing the project brief and assembling the project delivery team

Preparation of robust and accurate tender and contract packages

Undertaking various forms of tender and procurement processes

Preparation of the Building Contract

Facilitating progress meetings

The ability to analyse and review the Contractor’s proposals and ensure that the Employer’s Requirements are fulfilled

Procuring necessary consultancy services to develop a project to planning submission/tender

Regularly reporting progress to the Employer/Client

Issuing instructions in accordance with the building contract

Undertaking quality inspections

Dealing with defects

Dispute resolution

Issuing notices in relation to payments on a stage or periodic basis

Managing change and adjusting the Contract Sum where required

Assisting the Client with their social value targets

Undertaking the final defect inspection

Dealing with the Final Account

BWA also have experience managing bespoke developments agreements including acting as ‘Purchasers Agent’ on Section 106 projects.
